Harris County grand jury indicts pair behind Planned Parenthood videos
8:21 p.m. CST January 25, 2016

HOUSTON -- A grand jury in Harris County indicted the two anti-abortion activists who were behind multiple videos accusing Planned Parenthood of wrongdoing with regard to fetal tissue procurement and donation.

David Daleiden and Sandra Merritt were both indicted on a charge of tampering with a governmental record, a second-degree felony, while Daleiden has an additional charge of prohibition of the purchase and sale of human organs, a Class A misdemeanor, according to the Harris County District Attorney's Office.

"As I stated at the outset of this investigation, we must go where the evidence leads us," said District Attorney Devon Anderson. "All the evidence uncovered int he course of this investigation was presented to the grand jury. I respect their decision in this difficult case."

Anderson said the grand jury cleared Planned Parenthood Gulf Coast of any wrongdoing with relation to the video.

Daleiden's group, the Center for Medical Progress, shot the undercover videos with Planned Parenthood officials. The video, one of five taped undercover by an anti-abortion group, showed Gulf Coast Director of Research Melissa Farrell discussing the administrative costs of harvesting fetal organs.

"Sometimes the procedures are longer, so then anything that we piggyback onto that for collection purposes, obviously, would have to reflect that additional time, cost, administrative burden," Farrell said in the video.

Farrell thought she was talking with two medical researchers.

"If we alter our process, and we are able to obtain intact fetal cadavers, then we can make it part of the budget," Farrell told them.

Planned Parenthood officials have said their clinics, with a patient's permission, sometimes donate fetal tissue for use in stem-cell research. Researchers may reimburse Planned Parenthood for costs associated with those donations, the organization has said.

Planned Parenthood contends the videos were heavily edited as part of a smear campaign.

When the video was released, Lt. Gov. Dan Patrick said Farrell's statements prove that Planned Parenthood is selling fetal parts for profit.

"The people of Texas will not accept this callous attitude toward human life, and I will not accept it, and that's why we asked the D-A to begin a criminal investigation," Patrick said.

The decision comes several months after lawmakers in Texas used the videos to go after Planned Parenthood.

At a July 2015 hearing, Senator Charles Schwertner of Georgetown used very affirmative language in his opening statements, saying the undercover videos at the source of this debate clearly showed alterations of abortion methods in violation of federal law.

Governor Greg Abbott released a statement following the Harris County grand jury's indictment that said, "The Health and Human Service Commission's Inspector General and the Attorney Generals' office have an ongoing investigation into Planned Parenthood's actions. Nothing about today's announcement in Harris County impacts the state's ongoing investigation. The State of Texas will continue to protect life, and I will continue to support legislation prohibiting the sale or transfer of fetal tissue."

Texas Attorney General Ken Paxton gave a one line statement that read, "The fact remains that the videos exposed the horrific nature of abortion and the shameful disregard for human life of the abortion industry. The state's investigation of Planned Parenthood is ongoing."

Lieutenant Governor Dan Patrick also released a statement saying in part, "The horrific nature of these videos demand scrutiny and investigation."

No criminal wrongdoing has been found by Planned Parenthood in multiple states that have carried out investigations in the wake of the videos release.

Where the video crew went wrong was in the editing.

For those that have seen the raw footage, it was damning enough to Planned Parenthood.
But, the activist decided to to make them even more grizzly, and that is where they went wrong.

They will beat that phony misrepresentation charge in the indictment. But they will have to explain in a later Civil Action why they chose to get too creative with the editing.

If you are wrong, you are wrong. Period. Regardless of how reprehensible PP is, they still have thr right to be characterized with the truth, not creative editing to make things look even worse.

One would have to see the unedited tapes to know whether the editing characterized what PP was up too. I'm perfectly willing to let it play out but I maintain PP is taking a huge gamble with their tactics in this case. If they take it to court and it is on the record what they were really doing, they might not be able to worm their way out of it.

They need it to go away so liberals can keep on aborting babies that the irresponsible parents want to throw away.
