I guarantee they're going to use this as an excuse for not issuing tariff rebate checks they were babbling about (which were never coming anyway, but now at least they have a half-baked excuse).

Actually, it's a procedural step to return that issue to the Court of International Trade.

It means we're closer the refunds becoming reality.

Closer to becoming a reality for the small business owners, but not for anyone else. And those prices won't be coming back down. The damage has been done.

If you own a business, you MIGHT see a tariff refund. Nobody else will, though, and those businesses won't be lowering their prices back to pre-tariff rates. The damage has been done. Thanks trump.

The majority ruled that the president could not unilaterally set and change tariffs because taxation power clearly belongs to Congress.

In his ruling, Eaton wrote that he alone “will hear cases pertaining to the refund of IEEPA duties.’’ The ruling offers some clarity about the tariff refund process, something the Supreme Court did not even mention in its Feb. 20 decision. Trade lawyer Ryan Majerus, a partner at King & Spalding and a former U.S. trade official, said he expects the government to appeal or “seek a stay to buy more time for U.S. Customs to comply.″

I doubt that it will ever be a reality to any purchasers, but probably to some retail importers. It would be VERY hard to roll that down to end users / consumers specifically and at any specific percentage.

I'm in favor of 122 authority, if it's used legally. Haven't see that there's a legitimate balance of payments deficit, though.
