Actually, it's a procedural step to return that issue to the Court of International Trade.

It means we're closer the refunds becoming reality.

Closer to becoming a reality for the small business owners, but not for anyone else. And those prices won't be coming back down. The damage has been done.

If you own a business, you MIGHT see a tariff refund. Nobody else will, though, and those businesses won't be lowering their prices back to pre-tariff rates. The damage has been done. Thanks trump.

In a defeat for the Trump administration, a federal judge in New York ruled Wednesday that companies that paid tariffs struck down last month by Supreme Court are due refunds.

Judge Richard Eaton of the U.S. Court of International Trade wrote that “all importers of record’’ were “entitled to benefit’’ from theSupreme Court ruling that struck downsweeping double-digit import taxes President Donald Trump imposed last year under the 1977 International Emergency Economic Powers Act (IEEPA).

The Supreme Court foundthose tariffsto be unconstitutional under the emergency powers law, including the sweeping “reciprocal” tariffs he levied on nearly every other country. The majority ruled that the president could not unilaterally set and change tariffs because taxation power clearly belongs to Congress.

In his ruling, Eaton wrote that he alone “will hear cases pertaining to the refund of IEEPA duties.’’ The ruling offers some clarity about the tariff refund process, something the Supreme Court did not even mention in its Feb. 20 decision. Trade lawyer Ryan Majerus, a partner at King & Spalding and a former U.S. trade official, said he expects the government to appeal or “seek a stay to buy more time for U.S. Customs to comply.″

I doubt that it will ever be a reality to any purchasers, but probably to some retail importers. It would be VERY hard to roll that down to end users / consumers specifically and at any specific percentage.

I'm in favor of 122 authority, if it's used legally. Haven't see that there's a legitimate balance of payments deficit, though.

The admin has said in court that they can't currently issue refunds for Tariffman's illegal IEEPA tariffs, but may be able to begin the process in April.

Nintendo has sued the Trump admin after the court ruled importers are entitled to refunds of the illegally implemented IEEPA tariffs.

I hope they get them. There's about $166 billion at latest estimate to be refunded.

Anyone want to argue they're not entitled to the refund?
