I have a theory!
In any society, there will be rebels. People will want to break the law at least a little, some will make their career on the edge - hence organized crime always exists.
So it is better for society if some relatively benign things are illegal. That way the lawbreakers and organized criminals are occupying more of their time and energies providing and buying say pot, gambling and sex for money and less time and energy providing and buying say heroin, murder for hire and sex slaves.
You still have the latter, but maybe less of it for making the former illegal.
