So....and I've not the foggiest as to the particulars concerning this "associate" of yours, so it's just a question, k...is a "ca$h re-payment" the only way to settle this loan? I mean, ijs...right?

It was cash that was "borrowed" not given to her with a signed note to repay therefore I expect my associate to repay it back on the promised date of March 14 but I don't believe and she has said that she was not going to pay me back but I will give her to March 14th I'll see how it goes tho.

I'd recommend just take the loss. Did you run a credit check? But if you REALLYREALLY wanted to persue it, maybe you could sell it to a collection agency, or a collection goon depending on how you want to handle it. And I'm assuming the promissory note says something like the original loan amount at a 14.29%, and not $400 will be repaid, in that case wouldn't the interest continue to accumulate?

The loan was 350.00 with 14.29% interest which comes out to $400.02 that would be due on March 14, but after doing the research most likely I am going to take a lose on it but I could still pursue tho she signed it, had it notazied with a witness present as well but I guess it doesn't matter. I am still gonna wait to see if she pays it back if not so be it and I didn't do a credit check I don't think she has good credit that's why she came to KOdallas1986 loan services lol.

I do think that sucks, and I absolutely hate how people would not honor their word. Did you try to forgive the interest and just ask for the 350 back? Also loaning money is always a bigger risk then reward.

Its always a risk you are correct but she still has till the 14th of March if she honors the note I would be willing to let the 14.29 interest($50.02)go and settle for the 350.00 but I'll have to just wait and see.

Hate to say it but you are right if I trusted her to pay it back I would'nt needed a note but I am not gonna trip tho I am lucky enough that 350 isn't gonna break me, in the last run she will need me b4 I ever need her but I was trying to help but at the same time get something on paper to protect myself aka get my money back but no worries.

Yeah, seeing that he had her sign a note in front of a notary(both parties need to present ID to the notary).. I doubt he would be willing to have a notary present during the next "transaction".


There is nothing stopping him from accepting fuckery for repayment and then still claiming that she never repaid him in court.

It would be a funny ass Judge Judy moment when she snapped back...

You can go to small claim court, but I know from experience that it isn't worth it. There are costs to you, and you have to pay to have her served with papers. When the case is set she probably won't show up and you'll get a default judgment, but you have no way to enforce it. You can place a lien on her property if she has any, but that's not likely to get you anything. Maybe if you get a judgment you can report it to the credit bureaus, but she probably doesn't care. Basically, just write it off. BTW, IANAL but I went through this process in another Texas city so I'm speaking from experience.

One other point. What kind of "associate" is she? If it's a business association, I would sever that right away.
