Wow, this is a long thread. I am a professional published photographer. Here's my "opinion"

1. Whoever takes a photo owns the copyright. If you ask your friend to take a photo of you using your own phone, your friend owns the copyright to that photo. On the other side, the model owns the "likeness".

2. The copyright holder has control to what happens to the photo. However, there are limitations. For example, an ad company wants to use the photo. This would be a money making venture, the copyright does not extend. The copyright holder needs to get permission from the model to use the "likeness". . Same thing if that photo is to be published in a magazine.

3. "Model Release (contract)" - This is probably the most misunderstood document in modeling/photography industry. When a model signs a model release, the model is "releasing" rights to the likeness to the photographer. Most of the time, all rights are being released or given to the photographer. The photographer/copyright holder can now do anything with the photo. This includes anything for profit.

4. How would models protect themselves? First, do not sign a release, this is especially if you are paying for the session. If you are paying for photographer's services, ask the photographers to relinquish copyright to you. Now, the model has control. If the photographer, for some reason, wants to use your photo, that photographer will need a "license" to use your likeness.

5. "License to use likeness" - This is where the big bucks come in for the models. You can give full license, restricted license, license with limited time or expirations date ...etc. The models in the campaign ads in magazines are paid the big bucks not because they showed for a shoot but for the use of their likeness.

6. Summary, a photog can do whatever he wants with a photo as long as he is not making off them. He can put his watermark, post the photos on FB or forums, even use for educational purposes. Models has to give a license to use the likeness if the photo is to be used for anything for profit.

This thread is way to long to read but the copy rights are owned by the person who created the art work. When you hire a photographer normally the copyrights are transferred to you. When models do work for TF which means either for model or portfolio building with no fee usage rights of the photos and restrictions are controlled by the photographer. So if the photographer had a watermark requirement and it is removed then the photographer can file a DMCA take down request and sue if it is not complied with.

Sorry if somebody already mentioned this.

I don't do contracts. The ladies don't want their real names out there and neither do I. So we go on a hand shake and trust. I'm an escort and photographer, so I totally understand the need for privacy.

The ladies trust that I will not do anything to their photos unless asked permission. If she retires and wants her photos taken down from my site, I take them down immediately... Also, the lady has the option of a watermark or not. I give them both if asked...

2) If thats "you" who took those? LOL

I'll be starting a national thread before long about BIG ASS BANNERS across pictutres and "Copy Rights". I hope photographers like your self get a lot of new business once that threAD gets started.

No thanks, I don't want a large watermark fucking up the possibilities of me finding other artist to work with. Walking around with one of those would be like being branded like I was your property! We all know how that's gone over in America's past? You should be grateful that you got added exposure instead of being a fucking Prima Donna! How often are you showing your hooker shots? And to who are you showing them? How about the ladies who don't want their faces revealed? Are you making sure that you retain rights to show their facial images unblurred with your artistic rights?

In my opinion you have shown the ladies of this community exactly who they should be staying away from. Most are repulsed by the thought of having someone else pimping them out. I see no difference if their images are being pimped out by a photo pimp!
