🔻 What Happened
The judge ruled that interim U.S. Attorney Lindsey Halligan had been unlawfully appointed in violation of federal vacancy statutes that normally require Senate confirmation for U.S. Attorneys. Because Halligan was the only prosecutor who signed both indictments, Judge Currie voided them entirely.
Very important to remember… The dismissals were without prejudice and DID NOT reach the merits or evidence in either case.
🔻 Why There Is Still Room for Optimism?
1. Attorney General Pam Bondi stated the DOJ will appeal both rulings to the Fourth Circuit “within days,” arguing the appointment of Halligan was lawful under emergency provisions or presidential authority. — This was the entire reason it was thrown out, because “Halligan was illegally appointed”
2. Because the dismissals were procedural only and without prejudice, a properly appointed U.S. Attorney can re-indict Comey and James on the EXACT same charges as soon as the appointment issue is fixed.
3. The mortgage-fraud counts against Letitia James remain well within the normal 5–10 year limitations periods, making refiling straightforward.
4. Re: Comey, Although the original five-year clock on most of Comey’s false statements technically expired September 30, 2025, federal law (18 U.S.C. § 3288) gives prosecutors a new SIX-MONTH window to re-indict after a dismissal for technical defects — a window that only started running on November 24. If the appeal succeeds or a new prosecutor acts quickly, Comey can still be re-charged. Also remember, Conspiracy Against Rights restarts the clock everytime they extend the lie… and here he is, doing just that.
5. Neither ruling criticized the strength of the cases; the underlying grand-jury indictments, witness testimony, and documents remain intact and unexamined by any judge.
In short … the indictments are currently dead because of who signed them, not because of what they say. Fix the signature (via appeal or new appointment), and both James Comey and Letitia James will be back to square one. The DOJ has publicly committed to doing exactly that.
