Puzzlement
Pornography is legal. It is OK to pay actors to have sex.
Prostitution is illegal. It is not OK to pay someone for sex.
If I were a porn producer/director, and I star in my own films, it is legal to pay an actress to have sex with me in front of the camera, but it will be illegal to pay the same "actress" to have sex with me without the camera!

This is something I'll never understand, why one is legal while the other isn't.

I agree with you Jack, It is weird. When I did a shoot I had to fill out a legal form with a scan of my drivers license stating money is NOT for sex it is for my time and modeling.

Just film your sex
As long as you film your encounters you are making porn which is legal.I wonder if any SP would go along to try it and see what would happen if she ever ended up in court. It could be a first step in eliminating our stupid puritanical laws.

Maybe I don't even need the camera if I am just rehearsing for the shoot.

In that case you could say the provider was just the fluffer.

Actually, in most states, filming pornography is not legal if you are having sex with the actor/actress. It's only legal in a few places like California which is why the vast majority of porn is filmed there. The law in NY is really fuzzy. But basically, you can film an actor to perform "modelling", which might include sexual acts done to themselves, but if you were to get any sexual acts returned, then it's illegal. It's extremely stupid. But basically the law is that if you were to get any sexual gratification (ie sexual acts performed on you), then it becomes illegal.

This whole issue seems like it's rooted in Puritan beliefs:
"If it feels good, stop it."

I wonder if the "Zumba Madam" is going to use the "I was simply shooting my own amateur porn" defense.

It sure is. Really as is with all the silly laws in regards to prostitution and such. It's unfortunate, but too many laws are based on a minority's morality vs. logical arguments.

And as such, most states will fall back to literal interpretations of their laws on prostitution. Which would in that case make it illegal as sex for money is being exchanged. Now...if somebody had the guts and the money to take the chance, get arrested, and then fight it to the Supreme Court, there's the possibility it would be upheld by the 1st Amendment. But I don't know too many who would do such a gamble.

I find strange that it's illegal to show a 17 year old pornography. However in NY, fornication with a 17 year old... well that's ok! (Of course not discussing the hobby world here.)
Always wondered if I was with a 17 year old and taped it, could I legally show her our own video?
