You mean this phone call - yeah that charge got tossed :

The order from Judge Scott McAfee dismissed six counts related to a specific charge: Solicitation of Violation of Oath by a Public Officer. That charge specifically relates to Trump's Jan. 2, 2021, phone call to Georgia Secretary of State Brad Raffensperger, which in part sparked the probe.

Either inexperienced Judge Scott McAfee erred when he did not disqualify both Fani Wills and Nathan Wade

OR

he wanted to take the heat off him and have someone else make the decision

BREAKING: Fani Willis Accused Of Illegally Recording Phone Call

Fulton County District Attorney Fani Willis is facing allegations that she illegally recorded a phone call between her and a defense lawyer for one of the defendants in Willis’ RICO case against former President Donald Trump and a number of his allies.

In an interview with legal analyst Phil Holloway, attorney Christopher Kachouroff, who is representing Trump co-defendant Harrison Floyd, alleges that Willis recorded a phone call between her and one of Kachouroff’s Maryland-based colleagues. The recording was conducted without their knowledge.

Floyd, who founded an organization called Black Voices for Trump, is one of 16 remaining co-defendants in the case.

“She did reach out to us, one of my colleagues in Maryland, and was rude, abrupt with him on the phone, and he was dealing with the Maryland case and I was dealing with the Georgia case, and she ended up recording him,” Kachouroff said.

This would be a violation of Maryland’s Wiretap Act, under which recording a private conversation without consent from both parties is a crime punishable by up to five years in prison and fines up to $10,000. The law is different in Georgia, which is a one-party consent state.

A defendant in the Trump Classified Documents case said that he will give Fulton County, District Attorney Fat Ass Fani Willis until Monday to recuse herself, otherwise he will pursue legal action amid allegations she illegally recorded his lawyer’s phone call.

It's another nothing burger. In GA- 6An individual can record in-person conversations where either the person is a party to the conversation or at least one of the participants has consented to the recording. Ga. Code Ann. §§ 16-11-62, -66(a).

The statute only applies to the “private conversation of another which shall originate in any private place,” so consent would not be required to record conversations occurring in public. Ga. Code Ann. § 16-11-62(1).

As long as one person who was part of the conversation is okay with the recording, then that's all that's needed. Obviously Fani counts as one of those persons, so the recording is legal.

Sorry to burst bubbles. What's more shocking is how many deflecting techniques in actions that the GOP and conservatives are trying to use to discredit Fanny for putting the truth out into the light of day. What's so problematic about the truth?

Did u take into account this was a phone call from another state? If it was, it would seem to me you have to take into consideration maryland law also.

If the law was being broken in the state of Maryland, IE: the recording happened in the state of Maryland and there was a complaint, then perhaps it would matter. THe reality is the state laws of GA are the ones in concern here, and there is a single party permission requirement. Fani- didn't go over a state line to have that conversation, ergo- no state laws were broken. Further, Federal law requires ONLY 1 person to have knowledge and full consent, under Fed Law,18 U.S.C. 2511 (2)(d), requiring only that one party gives consent.

It's a nothingburger with extra nothing sauce. The bigger question is what are conservatives and the GOP so worried about when a grand jury has already determined that enough laws were alleged to be broken, that they supported the investigation and charges. If the truth will set you free- then DJT and the rest of those who are asked to testify- have nothing to fear. I suspect that all those attorneys who pled guilty have far better understanding of the hot water they would be in/ are in., and those who stand defiant, are likely going to be in for a rude awakening.

It's a shame it wasn't started like 6 months ago though so that ALL voters would be able to make the decision for themselves on the content of the trial on TV, just like they did for OJ and others who's trial was televised. I doubt it will get that far however with the pending litigation and appeals. Certainly not till after November 24.
