there is a law called "habeas corpus" where they are protected from unlawful detention.
They have to appear before a judge in a timely manner (usually 24-48 hours) for formal charges to be brought.

Best get a lawyer and file a writ of habeas corpus for release.

which essentially tells the prosecutor, "charge me with a crime or I go free"
but speak to a lawyer first

If the charges were thrown out on a 4th Amendment violation she should talk to a good attorney about suing the local PD, the arresting officers personally, and the city for the civil rights violation. Maybe even the county prosecutor since he would have known from the police reports that a violation had occurred and let it slide. One of the only ways to get the police to take civil rights seriously is to make them pay when they violate them.

If the lady didnt do anything besides post an ad LE doesnt have a leg to stand as long as she doesnt admit to anything. What can be proven from only an ad?

She should also make sure she has her record expunged by a good attorney when she sues the hell out of them. Small town cops and prosecutors can sometimes get away with violating habeas corpus because public defenders and appointed attorneys will not buck the system for fear of losing their livelihood, but she needs to look into this fairly quickly to make sure she files within the statute of limitations.

In small town Amerika you are sometimes guilty until proven innocent if you are charged with anything violent or "sordid" like prostitution, especially if you are an outsider (not from there). They don't often move fast sometimes to ensure the rights of anyone they don't know and who has no connections to that community. Not always, of course, but it can happen.
