Default need a little advise

make a long story short I allowed a friend to move into my home this Jan when she became homeless. I know big mistake. its been 60 day now and I have asked her to leave and she has refused, says its to cold to be homeless but she has a car and the weather is warming now.

however, today she said her car is broke down and not drivable and its no longer in my driveway. I have given her a notice to leave by the mar 10th. she refused to sign or take it. anyone out there have a reasonable suggestion on what to do now.

There are a lot of TV ads out there for attorneys...

It would seem logical to assume, though, that since she is no longer an invited guest, it’s your house, but she refuses to leave, it may be considered trespassing? See if police can threaten her with charges if she doesn’t vacate. My 2 cents of non-legal advice.... oh, got to run, another episode of Law & Order just started...!

The same situation happened two years ago to a friend of mine. The police told him that It has to be handled the same way a landlord would handle it. She needs a thirty (30) day notice to vacate and that after that if she isn't gone you have to go to small claims court and file a lawsuit to evict her for unlawful detainer. She doesn't need to sign it. And since she doesn't owe you any money she can't fight it. The courts usually send a sherriff over to help remove her things on the third or fourth day after court. She hasn't broken any laws since she was invited by you to stay.

Just Right, your friend is no longer a guest. It really doesn't matter if she has paid rent or not. She has lived there too long. Did she get mail sent to her there? If so, then she has proof of legal residence. To do it right, you legally have to give her a 30 day notice. Then you have to get the Sheriff to evict her after 30 days. I know it sucks. In my case she had warrants and when she got picked up by the State Police, my problem was solved. She cost me a lot of cash. I fell for her homeless speach too, which wasn't a lie.

If she had no mail come to her or friends come over, then I would move her out to the last tack on the wall. I would put in new dead bolts. A no trespassing sign is a must. It must be posted where it can be seen. A mean guard dog would also help, if a friend has one to loan. If she returns and tries to break in, call 911. If they ask to look inside, you could show them she has nothing there. They won't arrest her unless you make a complaint. Probably just tell her to move on. I feel your pain because I was in the same situation. They are homeless because they have made the worst choices in life. They bounce from couch to couch. Until they get booted out. You think your helping them but they are just playing you. I wish you all the luck.

Personally, I would clean out all of her crap and change the locks. Sure your likely committing some sort of civil tort but I doubt she has the means to sue you if she truly is homeless. The police don't enforce civil law, so they won't do anything about it.

As you noted, that was a bad decision. She has a legal right to be there now, and you'll probably need to go the routes that Kinder and/or TailHooked described.

I hate to tell you this, not sure if you're in Clay county or not If you are you have to serve a formal eviction giving her 30 day notice. You can find one on line free. If she does not vacate you have to take her to court to get a court order to vacate at which time you can involve LE. W/O the court order it's a civil matter, the only thing LE can do is make sure no violence breaks out. Another option.. get a stubborn lady to make frequent visits making it to uncomfortable for her to stay. Like a stray don't feed them or they never leave.

Yes after giving notice be careful. Just right seriously I could swing by maybe having a female or someone in general around will help convince her to go. You know how to reach me
