Well, nationalizing the banking industry was shot down a couple of hundred years ago by Chief Justice John Marshall, and since that decision is still good law, don't really see that happening.....

But Big C it is already happening, through the spending rights which you stated are not limited by the Constitution. The govt has a right to spend wherever it sees fit and it can make any condition upon that spending. Example: uncle Sam will forgive the loan if.... the bank does this or that meaning losing control. And oh by the way bank if you do not comply we will pull our FDIC on some little technicality.

To think that banks really have a choice of whether or not to take free money is ridiculous. Hey bank I am gonna save your ass and you execs I am gonna save your asses too, but you have a choice to tell me "no." Come on!! The bank has to take the money to survive, albeit the dumb ass bank got into that position on its own but lets see, I am drowning and a person throws me a life preserver, Do I have a choice to refuse that life preserver? Not really. And then the lifeguard tells me I will pull you in to safety but only if I can have control over your existence. Again am I really gonna say "no" I prefer death?

And let us not forget that Uncle Sam can always change the rules as things go, the banks do not have that option but Uncle Sam does, and he usually changes them. For example is Social Security the same as it was when created. All money taken in got spent to the retired and disabled. Does the govt spend all that money today on retirees? Please people. The bank take over is just the beginning, name a prgoram that was started and later dissolved, not many. In fact, the Rural Electric Agency is still around and its purpose is to ensure people in rural areas can have access to electrical power. Somebody tell me who in this country does not have access to electricity if they want it? Why is the agency still alive?

It is not a bailout - it is a takeover, call it what it really is. Does everyone know what a bill or law is called is usually the opposite of what is in the law. The Clean Air Act tells companies how much pollution that dispense into the air. The Clean water act same thing. Tells corps. it is okay to pollute, granted it also limits amounts, but says pollution is okay. The Patriot Act - I have never seen anything so unpatriotic in my life. Tells us Uncle Sam can do whatever he wants to us a scitizens as long as he is trying to prevent terrorism. So the bailout, implying help, is not help it is a takeover!

Thanks for letting me rant!!! Now I have to go out of town for the Weekend, see what happens to me when I do not play on Fridays!!! I start ranting!

They passed the Patriot Act in order to prevent terrorism on the homefront, and they have the Homeland Security Agency with Ms. Napolitano (or whatever the fuck her name is) in charge.....The gov't has tried to stretch those things way beyond the intended means and have tried to use thos laws to turn this country into the Nazi state.....The gov't can make loans to the banks to bail them out and they can put conditions on receiving those loans on the banks and the bank execs.....If the banks and the bank execs default on those loans, the gov't can foreclose on those loans just like any private company can foreclose on a loan they made to you or me.....Seeing as how the feds are wanting to get money back and NOT go into the business of running a bank and/or trying to nationalize the banking institution into a Bank of the US because their actions would get struck down (at least one would hope the Supremes would uphold the law and strike it down), my guess would be that they would sell the property to the highest bidder and then try to collect the deficiency from the lendee (who I'm sure if they had an ounce of grey matter would have filed a bankruptcy or initiated some other kind of stay proceedings against the gov't)......

Therefore, I don't see that your scenario could possibly happen because there are just way too many smart lawyers around who know that the way you do stop an over-aggressive federal gov't is to take it to court......I've seen some instances where the Justice Dept has been halted (even using their Patriot Act reasoning) because the court felt that they overreached their bounds.....Same thing should happen here in your scenario.....Not that I don't think someone in the fed gov't wouldn't try it.....Hell, until recently I didn't think anyone would write a bill and sign it into law that you could arrest and detain people who you suspect are in this country illegally and require them to show proof that they aren't illegal aliens.....But look at what has happened in AZ (and if that law doesn't get stricken as unConstitutional then nothing ever will).....Ok, let's not get off into a discussion of that ridiculous situation going on in AZ (but feel free to start another thread on it if you want as I'd love to hear what people have to say on that issue).....

To sum up my feelings here (in case you haven't gotten it), I just think it sucks donkey nutz for gov't to always be willing to bailout big business and reward them for their folly, but then won't do the same for the little guy like you and me who if our business goes under, we're just plain fucked (and not in the carnal way).....

There alot of people coming out and saying that omama is doing and end around of the laws and setting himself up as an imperial president. He won't have to answer to the courts or congress, example is all the czars, not one was confirmed by the senate and don't have to answer to them either. He will select several justices in this term and have them in his back pocket, and have a liberal court. His next move will be to pass an immigration bill and then give amnesty to all illegals, giving the Dem's tons of votes this fall to help save them.

And there are also a lot of people who are making insane statements about Obama just because they don't particularly like this president for whatever reason.....Obama hasn't done anything in his appointments that any other president hasn't done.....Presidents make appointments and give plum positions to people that are going to support their agendas.....It would be kinda dumb to do otherwise.....

Now, back to the issue of spending money bailing out big business.....Or as I like to say "Back to our regularly scheduled programming".....
