There have been two legal cases that addressed the issue of why the production of porn movies is not prostitution: California vs Freeman (1989) and New Hampshire vs Thenault (2008). The Thenault case used the same argument as the Freeman case. The Freeman case made the pornographic industry legal in California.

The State of California because it did not like the decision reached by the California Supreme Court in the Freeman Case appealed the decision to the US Supreme Court. Below is the response by the US Supreme Court.

In New York vs Big Apple Oriental Tours a decision was reached in January 2009 that the services provided did not constitute the promotion of prostitution. Big Apple Oriental Tours was a sex tour operator that provided tours to Asia. Their argument that time for money even if sex is strongly implied does not equal prostitution was successfully upheld in court. It was a very long six year legal battle.

Interesting findings, Absinthe.

1. I totally agree with you here. But you have to understand that it's really hard to meet quality women or men that you are sexually attracted to AND is willing to be the open-minded freaky bastard in the bedroom when you get there. We provide what is supposed to be that balance that everyone needs in their life. But I agree, most definitely not a substitute.

2. This is true both in the hobby and real world. And I think both questions are legitimate. When it comes to the opposite sex, worst case scenario is that you may want to spend time with a woman that may not be worth what you're shelling out. Whether that's a financial or an emotional toll.

3. I don't think it starts with the client only, I think it starts with the lady's view of herself as well, and this will in turn determine her clientele. And in turn, treating each other well will result in positive experiences in the hobby overall.

4. I soo agree with you about emotional connections. The time has to be taken in order for that connection to be reached. However, one thing people have to understand is you control NO ONE but yourself, and you can't hurt anyone who wasn't already hurt. You can't break a spirit that wasn't already hanging by a thread. So dehumanization starts within. Even if we don't have the best time, we can just chalk it up to bad chemistry.

5. I agree wholeheartedly with this statement. You have no arguments with me here.

6. As with my statements above, you can't damage someone who wasn't already damaged, and why this path isn't for every woman. A lot of ladies get into this the wrong way. The girls that just figured out that they were pretty, and that they could get what they need/want for that reason only. Who, without growth and education will know no other path but needing men for money. I think if they do legalize it in the US, I think there should be an education requirement. If you haven't finished high school, you should not be allowed to be a provider. (I know, dreaming, right?) But I agree with Lina, if you view this as a source of income, it will be draining in every way possible. There are ladies that I know that have done nothing BUT this. They look up and they're 40. With no skills to do anything else. It is a very sad reality, but a true one. I have preached this to every young woman that I can that this is not something you do out of desperation. Change the woman's opinion about herself, you change the way of the world.
As far as it's impact on society, if we don't take the opportunity at every turn to educate our young ladies about their options in life, no one will arrive at the decision to do this willingly. Their needs to be more focus on the youth of the US to prevent disparity among kids who may not have the guidance that they may need to make the best decisions in life, despite of what they see around them.
As for the comments on the legality of prostitution in other countries, it's being associated with human trafficking and slavery by those in the US because it's hard to know who's doing this on their own free will. And such is the case here in the US as well, considering the AMP market here.

I have enjoyed this post, and am sad that I could not reply sooner.
