A Bexar County jury on Wednesday acquitted Ezekiel Gilbert of murder in the death of a 23-year-old Craigslist escort.
Gilbert, 30, embraced defense attorneys Bobby Barrera and Roy Barrera Sr. with tears in his eyes after the not guilty verdict was read aloud by state District Judge Mary Román
Outside the courtroom, Gilbert thanked God, the Barrera family and the jury for being able to “see what wasn't the truth” and for the “second chance.”
Had he been convicted, he could have faced up to life in prison for the slaying of Lenora Ivie Frago who died about seven months after she was shot in the neck and paralyzed on Christmas Eve 2009. Gilbert admitted shooting Frago.



“I sincerely regret the loss of the life of Ms. Frago,” Gilbert said Wednesday. “I've been in a mental prison the past four years of my life. I have nightmares. If I see guns on TV where people are getting killed, I change the channel.”
The verdict came after almost 11 hours of deliberations that stretched over two days. The trial began May 17 but had a long hiatus after a juror unexpectedly had to leave town for a funeral.
During closing arguments Tuesday, Gilbert's defense team conceded the shooting did occur but said the intent wasn't to kill. Gilbert's actions were justified, they argued, because he was trying to retrieve stolen property: the $150 he paid Frago. It became theft when she refused to have sex with him or give the money back, they said.
Gilbert testified earlier Tuesday that he had found Frago's escort ad on Craigslist and believed sex was included in her $150 fee. But instead, Frago walked around his apartment and after about 20 minutes left, saying she had to give the money to her driver, he said.
That driver, the defense contended, was Frago's pimp and her partner in the theft scheme.
The Texas law that allows people to use deadly force to recover property during a nighttime theft was put in place for “law-abiding” citizens, prosecutors Matt Lovell and Jessica Schulze countered. It's not intended for someone trying to force another person into an illegal act such as prostitution, they argued"

Let me explain that a bit deeper so I don't seem so callous. Say someone comes into your house, grabs the money off the dresser, and runs out with it...would you stop them? Would you shoot them?

Yes, you likely would.

Girls think because they're stealing from tricks there is no danger of retaliation. Not all mongers are impotent old dried up fucks. Some can take care of themselves quite well.

Thieves are thieves...doesn't matter how they take the money really.

Thanks for the research Sue. There's just no way to comprehend killing a young woman over $150, a young woman who probably had a very sad history. We don't know anything about the jury, but I wonder if the man was acquitted due to a legal technicality or if the jurors, at some level of consciousness, devalued the victim because she was a sex worker. I suspect it was the latter.

While tragic, I don't think the title of this thread is altogether accurate. For the circumstances don't necessarily scream it being open season on escorts. It could be argued (and obviously was) that it was open season on thieves, scam/con artists, and those knowingly attempting to rip someone off through deception. Some people out there don't take too kindly to being fucked over. From both sides of the fence - be it a hobbyist or provider - if you're in this game to fuck people over - your time will come; one way or the other. It is what it is.

Technically this would have made it open season on escorts back in 2009. Either way the lesson you should take from this should be to use hotels, don't steal, and dudes don't ever let it get to this point.

The story should be linked in all those Alert Threads where whores are ripping off guys.

Hey Toyz.... perhaps you should extrapolate from the verdict and come up with some recommended responses for other lesser crimes.

Steal from the Client = You could be shot and killed
Arrive 40lbs heavier than your pics = ??
Bait and Switch = ??

And other questions come to mind like If a ho advertises that she offers BDSM and you restrain and whip her is it punishment or simply session?

Stories like this are a perfect argument for decriminalization. You'd see far fewer incidents like these if a client who just got ripped off by a provider + pimp could report an incident to the police w/o fearing for arrest for solicitation.

The same also applies to reversed roles: how long would the recurring offenders of the "Alerts" thread be able to rip off and abuse providers if she could press charges against abusive clients w/o fearing for arrest for prostitution?

Jade...I'm not on a "lets go shoot all hoogars" slant.

But...from a legal standpoint. Its Theft and can be met with deadly force.

I equate it to this. If you walk in my house. Go to my wallet. Take out money. And run out of the house, I am going to shoot you. Don't get caught up on the amount...think about if it happened to YOU.

If a John came in, saw your Hoogar "stash of cash" and ran out with it...if you had a gun, would you shoot him?

Tell me why I should not. Tell me why I am not justified. Tell me why a court would rule against me for shooting a thief dead.

That's what happened here...a girl stole money & paid the price. She accepted the risk and lost.

HOs will learn that this is not JUST a virtual world of eccie, backpage, myprovider etc. There is the REAL world where they live and where they ripped him off. In the real world there are a myriad of ways to pay for stealing. This guy just cut to the chase & provided an obvious legal solution. Other solutions are not as violent, but have permanent affects as well. All should be pursued in order to collect the debt, or, if that fails; to impact the livelihood and stability of the stealing hoogar.

A thief is a thief...don't rationalize the actions vs the penalties...


Its tragic that a hoogar was stupid enough to think she could get away with it. Its sad that a person died. But the court said "Yah, if she stole from me, I'd shoot her like the thieving dog she was". Don't get all teary eyed cause a thief died...it was a gene pool cleanse and she won't have any stupid children who might do the same to another guy. And she ripped him off on CHRISTMAS EVE. What an evil little Ho.

We have to live in the society we find ourselves in. Decriminalization is not an option.

This guy had good lawyers. If he had not had such good representation he would have been nailed. He probably turned down plea offers but his lawyers knew they could persuade at least a couple of jurors that he didn't intend to kill this girl. All he had to do was show that he might have had the gun to use defensively in his justifiable confrontation to retrieve the defrauded funds. With reasonable doubt in the minds of one or more jurors the aquittal results.

The lesson is to all that competent legal counsel in all criminal matters is the key.
