Over a year after claiming he was attacked on the cold streets of Chicago, Jussie Smollett today was indicted by a special prosecutor in the case that the former Empire star probably thought was behind him.The move by special prosecutor Dan Webb will find Smollett back in court in the Windy City on February 24 to face the new criminal charges and potential jail time over the widely covered January 29, 2019 incident. With time behind bars again a real possibility, Smollett was indicted on six counts of disorderly conduct over falsely reporting the assault by a Cook County grand jury.

“Further prosecution of Jussie Smollett is in the interest of justice,” proclaimed former U.S. Attorney Webb in a statement on Tuesday as news of the indictment leaked out of the County Clerk’s offices.
Representatives for Smollett did not reply to request for comment from Deadline on the indictment.
However, the brothers who were seen as “persons of interest” during the first days of the probe into the attack were quick to get a statement out via their lawyer.
“The Osundairo brothers are aware of the new charges brought against Jussie Smollett today by the grand jury,” the release this afternoon said. “As stated before, they are fully committed to the public knowing the truth about what occurred on January 29, 2019,” the statement added. “The Osundairo brothers will continue to cooperate with that process ands they thank the Special Prosecutor’s office for their tireless work in seeing that justice was administered.”
Initially treated as a potential hate crime by Chicago Police Department and garnering sympathy from a varied lot of Donald Trump, the Empire cast and creators Lee Daniels and Danny Strong, and many more, the tide turned against Smollett as “persons of interest” the Osundairo brothers claimed that it was in fact the actor himself who the mastermind of the attack.
Last spring, criminal charges were laid against Smollett, who has always maintained his innocence. If Smollett had been convicted on all 16 counts, he could have faced nearly 50 years in state prison. However, the case was suddenly dropped and sealed in late March 2019 upon request from the Cook County State’s Attorney’s Office with a $10,000 payment and some community service credit – which really ticked off then Mayor Rahm Emanuel and the CPD and saw the city itself go after Smollett for the hundreds of thousands of dollars in costs of the initial investigation in a still ongoing lawsuit
With the controversy surrounding the attack and the aftermath, Smollett was booted out from shooting the final episodes of Season 5 of Empire last year. The return of the Fox hip hop drama for its sixth and final season last fall saw Smollett seemingly permanently written out of the show, despite repeated pleas for his re-instatement by Terrence Howard, Taraji P. Henson and other leading cast members.


Perhaps Smollett will be happy and well served in jail for a period of time.

Perfect! this is sweet on many levels. first it holds Jussie accountable for his criminal fraud and it serves notice that fabricating hate crimes in general will be prosecuted and in specific attempting to FALSELY associate Trump with such crimes by mere innuendo will not work. it also shows you can't "buy your way" out by Jussie "graciously" forfeiting his bond a mere pittance of the cost incurred by the CPD to investigate this fake hate crime. it also shows that minorities are not above the law simply by being minorities and best of all .. are in fact quite capable of racism themselves. also recall there is an investigation of the City DA Foxx who was complicit it getting Jussie a "sweetheart" deal. her investigation is still ongoing and should result in her dismissal and disbarment. she has "lawyered up" already ..

After being contacted by a Chicago attorney who served as former first lady Michelle Obama’s chief of staff, the top prosecutor in Cook County asked the city’s top cop to turn over the Jussie Smollett probe to the FBI, according to reports.


Cook County State’s Attorney Kim Foxx reached out to Police Superintendent Eddie Johnson after Tina Tchen, the former senior Obama official, emailed the prosecutor saying the “Empire” actor’s family had “concerns” about the probe, the Chicago Sun-Times reported.


Tchen passed Foxx’s number to a family member of Smollett, and the ensuing conversations with the relative were later cited by the prosecutor as the reason she recused herself from the probe, according to the paper, which obtained messages from Foxx in response to a public records request.


Text messages show Tchen contacted Foxx on Feb. 1, three days after Smollett reported that he was attacked by two masked men who hurled racist and homophobic slurs at him and put his neck in a noose.


Tchen, a close friend of Mayor Rahm Emanuel’s wife, sent a text message to Foxx to set up an early morning phone call, according to the newspaper.


“I wanted to give you a call on behalf of Jussie Smollett and family who I know. They have concerns about the investigation,” texted Tchen, who sought to set up a call with Foxx before flying out to New York at 8 a.m.


The text messages show Foxx told both Tchen and Smollett’s relative that Foxx had reached out to Johnson about handing the probe to the feds.


“Spoke to the Superintendent Johnson,” Foxx emailed Tchen the same day. “I convinced him to Reach out to FBI to ask that they take over the investigation. He is reaching out now and will get to me shortly.”


The same day, Foxx texted with Smollett’s relative, whose name was blacked out in the released copies.


“Spoke to the superintendent earlier, he made the ask,” Foxx wrote. “Trying to figure out logistics. I’ll keep you posted.”


“Omg this would be a huge victory,” the family member replied.


“I make no guarantees, but I’m trying,” Foxx wrote back.


Fox told the Sun-Times this week that the relative expressed concerns about leaked information about the probe — information that media outlets attributed to “police sources.”

“They had no doubt about the quality of the investigation, but believed that the FBI would have a tighter lid on the information,” said Foxx, adding that the police commissioner appeared receptive at first to the idea of turning the case over to the FBI.


Police spokesman Anthony Guglielmi told the newspaper that the feds were involved from the start of the possible hate crime investigation, but that there was never any talk of the police giving up the case to the FBI.


Smollett, 36, who is black and gay, is accused of recruiting two brothers to orchestrate the attack because he was upset with his pay on the TV show, police have said.


He faces 16 felony counts of disorderly conduct for allegedly filing a false police report and lying to cops.


The brothers told police that Smollett plotted the assault, gave them money to buy supplies for the attack and paid them $3,500 for taking part in the alleged plot.


The brothers — Abimbola “Abel” Osundairo and Olabinjo “Ola” Osundairo — have not been charged.

A former top aide to Michelle Obama refused to be served a subpoena Wednesday related to her contact with Chicago prosecutor Kim Foxx in the Jussie Smollett case.


The subpoena was issued by former Illinois Appellate Judge Sheila O’Brien as part of her request for a special prosecutor to investigate the Cook County state’s attorney’s handling of Smollett’s criminal case, the Chicago Sun-Times reported.


O’Brien wants the former first lady’s one-time chief of staff, Tina Tchen, to produce “any and all documents, notes, phone records, texts, tape recordings made or received at any time, concerning [Tchen’s] conversations with Kim Foxx in re: Jussie Smollett” at a May 31 hearing.


But Tchen wouldn’t accept the subpoena, according to the process server.

When news broke that actor Jussie Smollett was indicted again for lying to Chicago Police about an alleged attack by Caucasian assailants, the memes wrote themselves. Insults started flying. Fans of justice were ecstatic. Then, the trolling of historical Smollett supporters emerged. The most epic came from Donald Trump Jr. as he went after Senator Kamala Harris.

Harris took some flack for calling the incident a “modern day lynching” even before it was known that it was all a hoax. She even went so far as to push anti-lynching legislation even though it is, of course, already illegal. Her attempts to virtue-signal the masses while in the midst of her campaign launch was bad enough, but the revelation that he alleged hired actors to pretend to beat him up made her situation much worse.
There are more reported hate hoaxes from Trump supporters than there are actual hate crimes committed by them. This is indicative of a false narrative attempting to become a self-fulfilled prophecy, but people like Jussie Smollett just aren’t that clever
