It does not meet the definition of employment, it is a retail transaction and there is no case law or statutory law prohibiting retail transactions with non-citizens.

In fact, it is perfectly legal to have wholesale contractor agreements with foreign nationals as long as illegal immigrants are not employed in the "United" States as part of the agreement. You calling someone a contractor doesn't make it so, BTW. If it looks like an employee arrangement, it would likely be judged as such, and you would be subjected to the appropriate penalties, including jail.
