This isn't about the law anymore. Most of the cops highlighted the past few years were legally doing their jobs. This is about public scrutiny. The idiots in Congress are jumping over each other to make a new law but the public is already punishing United and it didn't take an act of congress. If only they could go back to that day and offer the guy $5,000 for his seat and a flight on a private plane. Then again, why didn't they do that with their own crew. So many self inflicted wounds... Of course Munoz could always play the race card.

United and the Dr. had a contract. When the Dr. refused to leave he violated the contract. Violating a contract is in no way a criminal offence. This is a civil matter and the employees had no right to use force. The police should never have intervened for United. In fact they should have arrested the United employee for assault.

My analogy is this. If I sign a rental agreement and then do not pay the rent, I have not violated any law. It is a civil matter. Neither the police nor my landlord can physically remove me.

Since it is civil my landlord must take me to court and get a judgment forcing me out. Once the judge orders me to leave I must leave or it becomes trespassing at which time LE can force me to leave. Even then the employee can not assault me to get me out. I have been on the landlord side of this issue many times.

I say the guy walks with millions and more people will tell the airlines to fuck off once they are in a seat with a valid boarding pass.

In my opinion, the only reasonable way for an airline to resolve an overbooking problem is to conduct an auction.

In most cases, one or two (or more) passengers can be bought off on the cheap ( re-booking on a subsequent flight plus a voucher for a discounted or free future flight, for example.)

Although that's good enough most of the time, occasionally it won't suffice. That's where a sort of cash auction is the airline's best option. Just authorize a senior agent or flight attendant to keep upping the ante until a passenger (or requisite number of passengers) accepts the cash offer(s). By way of that method, it's pretty easy to quickly find someone to take the deal.

That would cost the carrier a tiny, tiny, tiny percentage of aggregate revenue, and in the long run would be much better than randomly selecting passengers to give the boot. Nowadays, many passengers who feel fucked over by an airline post about it on Facebook or other social media, thus saddling the carrier with enough destruction of goodwill to negate many thousands of advertising dollars.

Pretty obvious and pretty simple, really. But then one rarely hears anyone singing the praises of airline managements.

They should have just upped their offer to $2,500, free plane ticket the next day and free hotel stay. Guaranteed at least 3 people raise their hand for that. Better to pay $2,500 than $2.5 million. With the original offer of $800 which nobody was interested in, you might actually see fights break out in the seats over people who want the $2,500.

They offer, but I have been on some where not enough are willing to accept the offers. Flights into DC with lots of businessmen heading to meet with a congressman for example--any rational amount they could offer won't entice a lot of them.
