Trump and ICE are using the Alien Enemies Act of 1798 to justify the deportation of immigrants without due process. The use of the alien enemies act in this context is legally extremely dubious. It’s been challenged and going through the courts as we speak. Deportation without due process is problematic when they pick up a citizen by mistake. Without it how do they have the opportunity to prove their citizenship?

The Supreme Court has just issued a midnight order halting all deportations using this law as a justification until they can rule on its legality.

Like it or not immigrants are provided with rights under the 14th amendment until the Supreme Court rules otherwise.

Due process is the safe guard that protects both citizens and non citizens.
