Edit: am I reading this right? You're purposefully asking for someone to give you high claim value for the hail damage?

Regardless, I don't want drama with my ex. The last thing I need is for him to lawyer up. I'm SOLD on being better off and doing without his help. Yes, it is possible. If you are able to tell the judge that you don't want to rob the guy, that you just want your kids to get the care they need, the judge will likely rule favorably.

This is TEXAS. Here, the woman with the kids wins over the man with the money. (Traditional values are not a bad thing.)

Your biggest hurdle is getting to see the judge. Before you do, go online and read Family Law in Texas. Know your rights. Know the procedures. Know what the Law says you "shall" get and what you "may" get. You got your ration once from the judge. Go in informed and ready to move forward. He/She may give you more than you asked for, because you did your due diligence.

Family Law (Civil & Criminal) is all online. Use the State websites. Law Firms want your business. So, you may not get complete info.

You can do this on your own. I know several folks who have, while the Ex's all had lawyers.

This is good advice. You shouldn't have to hire a lawyer to get the judge to enforce the law according to what he ordered in the divorce paperwork. Most judges take it very personally when some asshat shows contempt for his/her orders. Look online for the procedure. There's also a legal aid office in Dallas that's free. Wages CAN be garnished to enforce your ex's legal obligations and child support can be garnished too. He should be paying child support, right?

Oh, well that's good to know. Guess the text you wrote asking for that in your op wasn't meant to be there.

Nothing illegal in high estimates, if the shop will back them. Oldest trick in the book, get 3 high estimates, then let your buddy do it for less.

Most insurance companies, these days, will make you use an "approved" shop and pay them directly. You are left to pay the deductable.

With most judges, probably not. As you have learned, representing yourself is extremely difficult, and for good, not "bullshit" reasons. The rules concerning the authentication of documents, for example, insure that parties can't introduce falsified documents. They are fairly simple rules, but to learn them with no legal background isn't very easy unless you have a mind that is very rule oriented. And authentication does not necessarily mean that they are admissible. That is a separate inquiry. So the reason judges hate unrepresented people is that the process often ends up with an unjust result and the law compels them to be party to that unjust result.

I think your judgment is probably correct. You can eventually force your ex to come and do the right think if, and only if he has significant earning power and isn't under competing support orders to the extent that he is essentially bankrupt. But it takes 1) and cooperative judge who doesn't mind putting deadbeats in jail; and 2) probably $15,000 of attorneys fees and a GOOD FAMILY LAW LAWYER WHO a) will fight; and b) will fight in a cost effective manner. That's unfortunately pretty hard to find.

Send Apples corporate office a certified letter stating that their refusal to remove the braces is actually causing your son pain and mental anguish. Be nice and Appeal to there sympathetic side. Once they read how you stepped up and took care of this child, someone will be calling you within 7 to 10 business days trying to propose a solution.

As for hail damage, take it to an actual dealership, Mercedes, BMW, etc to achieve the highest estimate. If it's old, they won't even waste time doing an estimate, they will just advise you that the insurance company will most likely total it and not repair.
However, if you show that booty to the right Bodyshop guy, your wish will be his command.

No income as a mother automatically, qualifies you for legal aid in certain counties, that's of course you are requesting child support. If not, request for assistance will be denied.
