Schumer's hatchet gang has the strategy of jamming up the Gorsuch nomination in order to keep 8 judges on the Court for when the OE "Ban on Muslims" shows up. Schumer et al believe the SCOTUS will split 4-4 on the vote and thereby leave the 9th circuit court of appeals decision in place. Two things: ALL the justices on the SCOTUS are intimately acquainted with the "loons" on the 9th COA.
#1: I suspect the 9th COA gets more shit sent back to them than any other COA in the Federal system.
#2: If another COA is cited a 9th COA opinion to justify a holding in their COURT OF APPEALS, it is hardly noticed in an opinion.
#3: Look at the current SCOTUS regarding the Gore-Bush cases, Obaminable's OE's, and Obamacare regarding historical precedents and the separation of Feds vs. States and the Executive vs. the other branches.
#4: Regardless of political persuasion the SCOTUS has historically sided with "law enforcement" and "public safety" concerns when evaluating actions taken by the executive branches of the Federal and State governments.
