Who’s going to be the Guinea pig/pigs on September 1st? We will wait and see, because it will happen?

This entire state is a mess I hate it here. This is what happens when an entire state is controlled by a single party. The same applies to my home state California. But you are correct about the legalized weed and prostitution. I get that a Democrat proposed the legislation here but it had easy support from the Republicans cause they saw an opportunity to legislate the bedroom. For a party that prides itself on the right to ones body they do seem very interested in what someone does with theirs.

I look through the legislative session videos online.
About 4 hours and 21 minutes into one of the last sessions they bring up the amendment to the bill that escalates the charge to a felony. None of the earlier drafts of the bill contain this language. There was no debate, no real focus on this feature, only a few people were paying attention. I'd surmise the majority of the legislature had no idea this change was slipped in given the chaos of the 2021 legislative session.

Because I vote based on many other issues besides the hobby, which frankly is very low on the list of my political priorities.

Except that it was written by an African American Liberal Female Democrat from Houston so...
There's always the facts to consider.

A 2nd offense is even worse. Get caught twice offering to pay a suger-baby's rent and you're treated same as a kidnapper.
"A second solicitation offense jumps from being a state jail felony to a third-degree felony. In Texas, third-degree felonies are penalized by 2 to 10 years of imprisonment and/or a fine of up to $10,000."

I mean, I guess it goes without saying. If you do nothing that indicates solicitation, it seems it would be very difficult to prove you did.
I'd have to go through the "elements of solicitation", but if you don't solicit...how can they prove you solicited? Tipping doesnt prove solicitation?

So far I’ve not read anything to make me think these elements are changing with the new law. I suspect, though, that even under current law if you “tip” an undercover cop prior to the act you’re in trouble even today. Since I’ve never heard of a female undercover cop completing a sex act in order to secure an arrest, I still hold as long as you don’t mention money* you’re unlikely to get in trouble (possibly a higher risk if you’re caught up in a raid of a spa, but I’m thinking more in the line of sting operations to catch johns).
*you also have to be prepared to bail if the lady insists on entering into such a discussion before any sexual contact (or at least nudity on her part) has occurred.
I hope ShysterJon weighs in on the topic soon. A lot of the more fanciful scenarios discussed in this thread are deserving of comment from a real lawyer with experience in this area.

At the end of the day the Popo don't have any more personnel than they did before the law goes into effect. If you haven't figured it our yet, all of us probably break the law multiple times a day because there are so many laws on the books.
When the collectivists get done, anything that isn't illegal will be mandatory.
The cops aren't going to have any more man power to go after mongers than they do today... which is minimal. You probably only need to be concerned about raids not working with indies...
There is very little risk if you're sensible... sure everything could go tits up on you one day, but that's true today too.. the risk of being caught hasn't changed just the penalty.

Yeah the risk of getting caught seems to be about the same. The penalty is pretty harsh though. Who the fuck wants a felony on their record. Talk about life ruining

The risk might be greater at hotels. The new law makes mandatory training and posting signs at all hotels in TX.

Hotel workers learn to spot signs of human trafficking as part of new Texas law
"A new state law passed this year and taking full effect Jan. 1, 2022, requires hotels and motels to train their employees on human trafficking prevention and reporting. These businesses also must post signs with reporting information in areas visible to employees."
