If convicted on both counts, James faces up to 60 years in prison and a fine of up to $2 million.

James, 66, bought the three-bedroom, one-bathroom Norfolk, Va., home in August 2020 for roughly $137,000, most of which was financed with a $109,600 loan that prohibited it from being used as a rental investment property, prosecutors alleged.

That allowed her “to obtain favorable loan terms not available for investment properties,” they noted in the five-page filing, saving her “approximately $18,933 over the life of the loan.”

When a Post reporter visited the Norfolk home in April, neighbors said they had never seen James at the property.

Meanwhile, her income tax forms designated the home as a rental that brought in thousands of dollars in additional income.

Spoken like a true Republican. Republicans don't care about anybody except themselves and their own. How many million did they say our not going to be able to afford their insurance? But hey as long as you got yours and people that's working got theirs more powerful to you. And you must have missed what happened to Colbert and Kimmel with there rights trying to take them away but you guys hated them anyway because they speak the truth.

Proving mortgage fraud is difficult because mistakes on paperwork are often made and proving lies is difficult.

Is mortgage fraud often prosecuted?

No. Banks can call in loans and take civil actions when they uncover misrepresentations, but federal prosecutors rarely bother with criminal charges — especially when the purported ill gains are small. According to an interactive data analyzer for the United States Sentencing Commission, 38 people were sentenced in 2024 for federal mortgage fraud convictions, and most of those cases involved dollar amounts in excess of $550,000.

To convict Ms. James at trial, prosecutors would have to persuade a jury not only that her paperwork contained an error, but also that it was an intentional misrepresentation and not an inadvertent mistake

Earlier allegations of financial fraud by Ms. James related to other properties proved thinner upon closer inspection.

William J. Pulte, a Trump loyalist atop the Federal Housing Finance Agency, has been sifting financial records in search of a basis to make criminal referrals against Mr. Trump’s adversaries. On April 14, he made a referral against Ms. James based on apparent paperwork problems with two other properties, including accusing her of falsely saying she would be the primary resident of a different house in Norfolk that she bought with her niece in 2023.

But two weeks later, her lawyer, Abbe D. Lowell, marshaled a detailed defense. After scouring the paperwork from the 2023 purchase himself, he accused Mr. Pulte of having misleadingly cherry-picked one form that incorrectly said Ms. James would live there while omitting that two others accurately stated that her niece would be its primary resident.

And it's NOT "cherry-picking" a form IF it's the one that claims
that Letitia James would live there and thus got the better mortgage
terms and valuations. ... If those two other pieces of paperwork
later claim that the niece would surely NOW be the resident, it
don't matter if Oscar the garbage man is also living there once
the initial mortgage fraud was done. -- It's still a CRIME.
