Chances are those same independents would have voted to repeal but none the less the ACA was infinitely more important to Obama and the Dems than the Patriot Act. If the Senate Dems had wanted the Patriot Act to expire they could have simply told Obama they would pass the ACA(since they had the votes) as soon as it did expire or he promised them that he wouldn't extend it.(of course no one in Congress would have trusted him on his promise) At any rate the Dems had the card and chose not to play it. In my mind that's the same as refusing to repeal it.
