I was wondering why the distinction between the two was seemingly arbitrary and came across this article. Parts of it are a bit dry, but it's pretty good nonetheless.

SOOO, your saying if I hire a provider to take pics of the fun I could have a legit argument in court, as hiring her as a private porn actress and a firm could possibly say they manage private porn models and not escorts? why oh why has nobody done that? har har

I'll guess it would not help for hiring "private" models because there's no "speech" involved.
