This is true, in searches incident to an arrest or stop, where the police are normally able to do pat downs and other safety checks, including opening containers that the believe in their experience to be potentially dangerous. It doesn't include if you throw it at them or otherwise show that its an object of danger, and then they probably can't search it (maybe) just confiscate it. Meh.
CAVEAT: If your cellphone is part of the crime for which you are arrested, not just incidental to the arrest, these cases aren't generally applicable. Think that one through, some other court will too
WHEW, if you think that was long, that's not all the modifying clauses out there and the road to jail is paved with insufficient legal advice.. .be wary.
The most IMPORTANT advice is that if you consent, they can still look at it. A cop can ask you, "can I see your smartphone" and if you say ok... then you might be consenting to have it searched. That'll all play out in court... inherently risky.
So... SAY NO. Always... can I search your car, NO. can I look at your cell phone, NO. can I open your trunk... NO. Make them get a warrant. They'll tell you that you get brownie points for doing it... ok... you might and if nothing is up anyway, your probably still safe, just know that consent, willfully given, is going to allow them to search.. and if you don't know all the exceptions and rules... you're in trouble. (and they vary from state to state)
