OK, as a public service, I will now explain the SCOTUS Trump v. Casa decision from earlier today like I would explain it to a seven-year-old. Or to AOC. (Not that there is a difference.)
This is all about what is known in the law as “equitable relief.” In non-criminal cases in courts generally, rulings result either in an award of monetary damages OR an order to do or stop doing something. That latter action is known as “equitable relief” or “equity.” Basically, it means that fairness says some sort of monetary damages are not enough, so the loser in the case must be forced to take some action or stop taking some action as a matter of fairness. In other words, “fairness” = “equity.”
The problem with equitable relief becomes timing. If you wait months or years before a final decision where you can enforce an equitable solution, the plaintiff (the person bringing the case before the judge) might be very badly harmed because the defendant’s (the person the case was brought against) actions could keep hurting the plaintiff in a way that cannot be fixed later. So, in such cases, judges of all types can offer things like a “preliminary injunction” or a “temporary restraining order.” Basically these things mean that the judge says “Hey, I know this case is not decided yet, but there is a chance that Mr. Plaintiff is experiencing real harm right now, so even though the case is not yet decided, I am ordering Mr. Defendant to stop doing what he has been doing for the time being until we decide this case.”
Now what I just described—the branch of law we call equity—has been part of American law since its founding, and is a carryover from ancient English common law. You can see equitable rulings at every level of practically every court—they are quite common and always have been.
The relatively new problem that Trump v. Casa addressed is what is known as “universal injunctions.”
Let’s say some court somewhere hears a case where Mrs. Jones sues her neighbor, Mr. Smith. Mr. Smith is building a duck pond on his property, and as a result water is leaking into Mrs. Jones’ basement. Mrs. Jones sues Mr. Smith in county court, and the judge issues a preliminary injunction that tells Mr. Smith to stop building the pond until the case is decided. A “universal injunction” is when the judge ALSO says “and every other person in America building a duck pond in their backyard must stop doing so immediately while we decide this case.”
Although my example is a bit hyperbolic (that means “exaggerated,” AOC) THAT is a universal injunction.
So what the Democrats have been doing since Trump took office is this. Trump will order some action Democrats don’t like. Democrats will forum shop for some extreme left-wing federal district in Massachusetts or New Jersey or some other deeply neo-Marxist state, and bring a case against what Trump did. The lefty federal district court judge will then right away say, “The plaintiff might win this, so I am issuing a preliminary injunction telling Trump to stop doing what he is doing, and because I’m a federal judge, this preliminary injunction does not apply just in my district, it applies everywhere in the USA.” Then, even though Trump can ultimately appeal all the way to SCOTUS, Trump’s action has been “enjoined” (i.e., stopped) for months or years until the case is finally decided.
This practice of universal injunctions has been going on for a really long time, and no one has done anything about it. It’s been like that sweat ball dangling off Dr. Joyce Brothers’ nose in a health club sauna that Roseanne Roseannadanna talked about—it’s just been hanging there but never failing for years and years.
But today the sweat ball fell off the nose.
SCOTUS looked at the American history of equitable relief and decided that equitable relief was always meant to apply ONLY TO THE PARTIES IN A SPECIFIC CASE, and was never meant to apply to all such situations across the country.
This basically means that when President Trump says “deport illegals” and some judge in Minnesota says “NO,” that “no” can only apply to the party bringing the case before that judge in Minnesota, and Trump’s order can be carried out everywhere else.
This is a YUGE win for the Constitution and the rule of law, and for MAGA.
(I know I have a lot of attorney followers, and to them I say, yes I know this is over-simplified. That is the point—so AOC can understand it. Or a seven-year-old.)
YUUUGEEE win. The Trump agenda can proceed apace without Marxist abuse of the Constitution and the rule of law.
