Civil is for the cost of the investigation. Smollett isn't off the hook for criminal charges either. not only the Federal mail issue but the FBI is checking into Foxx's actions. Her decision to drop can be overridden if it's shown she acted beyond her scope and with prejudice toward Smollett.
